1. Acceptance of Terms

These Terms of Use ("Terms") govern your access to and use of Global Customer Vision ("GCV" or the "Service"), a supply-chain intelligence platform operated by KHouse Holdings LLC ("KHouse", "we", "us", or "our"). By creating an account, requesting access, or using GCV, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not access or use the Service.

You must be at least 18 years old to use GCV. If you are accessing the Service on behalf of a company or other organization, you represent that you have authority to bind that entity to these Terms, and "you" refers to both you personally and the entity.

2. Service Description

GCV is a web-based analytics platform that aggregates, enriches, and visualizes public data about bulk liquid and solid terminals, consumer facilities, vessels, and supply-chain routes. Features include:

  • Interactive mapping of terminals, facilities, and rail infrastructure
  • Facility enrichment drawn from public regulatory records
  • Vessel tracking based on third-party AIS (Automatic Identification System) data
  • Derived supply-chain matches between terminals and consumer facilities
  • Transport route estimation (truck and rail) and cost estimates
  • Port import analytics from public trade data

GCV is currently in live beta pilot status, limited to the Savannah, GA region. The Service is provided free of charge during the pilot. We may introduce pricing, change scope, or discontinue the pilot at any time with at least 30 days' notice to active users.

3. Data Accuracy — Critical Disclaimer

All outputs generated by GCV are derived estimates, inferences, or snapshots of third-party data. They are NOT certified facts, engineering opinions, professional advice, or regulatory determinations.

Specifically, you acknowledge the following about GCV's data products:

  • Terminal and facility data is researched from public records and may be incomplete, outdated, or contain errors. Operator ownership, capacity figures, product mix, and contact details should be independently verified before business use.
  • EPA regulatory enrichment (permits, TRI chemical releases, SIC/NAICS classifications) reflects a snapshot of public EPA databases at the time of collection. Status may have changed. Always verify directly with EPA and state environmental agencies before relying on permit or compliance information.
  • Vessel positions and port calls derive from third-party AIS data (via AISStream.io) and are intended for commercial analytics only. GCV must NOT be used for vessel navigation, collision avoidance, search-and-rescue, safety-of-life decisions, or any other safety-critical maritime purpose. For navigation, consult official IMO, USCG, and NOAA resources.
  • Supply-chain matches are algorithmic inferences scored on NAICS-code feedstock mappings, product keyword overlap, geographic proximity, and other heuristics. A match does NOT confirm an actual commercial relationship between a terminal and a facility.
  • Transport routes are computed using OSRM (Open Source Routing Machine) and a networkx rail graph derived from FRA public GIS. Routes are illustrative estimates, not operational routing plans. They do not account for current road conditions, rail track closures, service restrictions, clearances, hazmat corridors, customer contractual arrangements, or carrier capacity.
  • Cost estimates combine published tariff rates, industry averages (ATRI truck rates, STB Waybill rail rates, Clarksons ocean freight indices), and commodity-specific rate assumptions. They are rough planning estimates only and are NOT financial advice, investment advice, procurement quotes, binding rates, or guarantees of market pricing.
  • Port import statistics reflect Census Bureau International Trade data, which has known reporting lags, revisions, and aggregation artifacts.

You are solely responsible for independent verification of any GCV output before relying on it for commercial, operational, regulatory, or financial decisions.

4. Public Data Sources & Attribution

GCV incorporates data from the following public and third-party sources. KHouse is not affiliated with, endorsed by, or sponsored by any of these data providers:

  • U.S. Environmental Protection Agency (EPA ECHO, TRI, FRS)
  • U.S. Census Bureau International Trade API (port 1703)
  • U.S. Bureau of Transportation Statistics / Federal Railroad Administration (BTS/FRA rail GIS)
  • U.S. Army Corps of Engineers (USACE waterway data)
  • NOAA Electronic Navigational Charts and AccessAIS
  • U.S. Securities and Exchange Commission (SEC EDGAR financial filings)
  • Savannah Area GIS (SAGIS parcel data)
  • Georgia Environmental Protection Division (GA EPD air permits)
  • AISStream.io (real-time AIS vessel positions)
  • Project OSRM (truck routing)
  • Mapbox (basemap tiles)

Where these providers require specific attribution or impose licensing terms, those terms apply to your use of the associated data through GCV.

5. Third-Party Services

GCV relies on infrastructure and services from the following providers. Your use of GCV is also subject to their terms where applicable: AISStream.io, Mapbox, Cloudflare, Railway, and Supabase.

6. Prohibited Uses

You agree not to use GCV to:

  • Scrape, bulk-extract, mirror, republish, or resell GCV data, derived outputs, or UI content
  • Reverse-engineer scoring algorithms, match logic, or route computation
  • Harvest vessel positions, crew information, or voyage patterns for stalking, harassment, or targeting
  • Use GCV as a basis for vessel navigation, collision avoidance, or any safety-of-life decision
  • Use GCV as the sole basis for regulatory compliance determinations, permit applications, or government filings
  • Misrepresent GCV outputs as the position of EPA, Census, NOAA, USCG, or any other agency
  • Use GCV to make employment, credit, insurance, or tenant-screening decisions about individuals
  • Access GCV through automated means (bots, scrapers, crawlers) without prior written consent
  • Share account credentials, transfer access, or exceed the access tier approved for your account
  • Circumvent authentication, access controls, or rate limits
  • Interfere with, probe, or attack GCV infrastructure

7. User Accounts & Access Control

GCV access requires a KHouse account and administrator approval for the "gcv" application tier. We reserve the right to approve, deny, suspend, or revoke access at our sole discretion. You are responsible for maintaining the confidentiality of your credentials and all activity under your account. Notify us immediately at the address below if you suspect unauthorized access.

Because GCV is in beta pilot, access may be revoked, rate- limited, or tiered without prior notice as we evaluate platform load and user needs. Do not make business decisions that depend on continued GCV access without first confirming the status of your account.

8. Intellectual Property

Source government and public data remains in the public domain or subject to its original license. However, KHouse owns all right, title, and interest in the compiled GCV database (schema, enrichment pipeline outputs, scoring algorithms, match results, route geometries, cost computations), the GCV user interface, and the GCV brand.

Your account does not grant you any license to scrape, redistribute, sublicense, or create derivative products from GCV's compiled or derived outputs. Fair-use reference to GCV in published research, with appropriate citation, is permitted.

9. Limitation of Liability

GCV IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, OR NON-INFRINGEMENT.

KHOUSE HOLDINGS LLC ASSUMES NO LIABILITY FOR COMMERCIAL, OPERATIONAL, FINANCIAL, REGULATORY, OR OTHER BUSINESS DECISIONS YOU MAKE USING GCV DATA OR OUTPUTS. IN NO EVENT SHALL KHOUSE BE LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST REVENUE, LOST DATA, OR BUSINESS INTERRUPTION ARISING FROM YOUR USE OF GCV, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

During the free beta pilot, KHouse's total aggregate liability to you is limited to USD $0 (zero). If and when GCV transitions to a paid service, aggregate liability will be capped at the greater of (a) USD $100 or (b) the fees you paid KHouse for GCV in the twelve (12) months preceding the claim.

10. Beta Pilot Status

You acknowledge that GCV is beta pilot software. Expect:

  • Bugs, downtime, degraded performance, and breaking changes
  • Data refreshes, wipes, or resets without notice
  • Feature additions and removals without notice
  • No service-level agreement (SLA) or uptime guarantee
  • Possible pilot termination, with or without a successor paid tier

We welcome feedback from pilot users at the contact email below. Feedback you provide is non-confidential and may be used by KHouse to improve the Service without obligation.

11. Modifications to Terms

We may revise these Terms or the Privacy Policy from time to time. For material changes, we will provide at least 30 days' notice via the email on file for your account and/or an in-app notice before the changes take effect. Continued use after the effective date constitutes acceptance of the revised Terms. If you do not accept the updated Terms, you must discontinue use of GCV.

12. Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of North Carolina, without regard to conflict-of-law principles.

Informal Resolution. Before filing any claim, you agree to contact KHouse at the email below and make a good-faith effort for at least thirty (30) days to resolve the dispute informally.

Mediation. If informal resolution fails, the parties agree to attempt mediation through JAMS or a mutually agreed neutral mediator in Pender County, North Carolina, for at least sixty (60) days.

Binding Arbitration. Any dispute not resolved through informal resolution or mediation shall be resolved by binding arbitration administered by JAMS under its Streamlined Arbitration Rules, with arbitration in Pender County, North Carolina. The arbitrator's decision is final and enforceable in any court of competent jurisdiction.

Class Action Waiver. You agree to resolve disputes with KHouse only on an individual basis. You waive any right to participate in a class, consolidated, or representative action.

Small Claims Exception. Either party may bring an individual action in small-claims court for disputes within that court's jurisdiction.
